…says lower court lacks jurisdiction
The Appeal Court sitting in Abuja on Monday affirmed Dr Asue Ighodalo as the candidate of the Peoples Democratic Party PDP in the September 21 governorship election in Edo State.
The appelate Court held that holds the Plaintiffs in the lower court (before Ekwo J) were delegates and not aspirants.
Therefore the subject was within the Internal Affairs of the Party.
The Delegates were not aspirants and therefore had no locus to bring this suit and the court therefore had no jurisdiction to hear the matter.
It subsequently set aside the judgement of Justice Ekwo for lack of Jurisdiction.
