The Indigenous People of Biafra (IPOB) has asked the Federal High Court in Abuja to throw out all charges against its detained leader, Nnamdi Kanu, saying the prosecution has failed to present enough evidence to proceed with the case.

In a statement issued by its spokesperson, Emma Powerful, IPOB referred to a legal reply filed on 14 July 2025 by Senior Advocate of Nigeria Chief Kanu Agabi.

The filing was a response to the Federal Government’s opposition to a no-case submission made by Kanu’s defence team. IPOB described this as a significant legal development, insisting that the case against Kanu lacks constitutional and evidentiary backing.

The group argued that the prosecution did not address key concerns raised by the defence, including the absence of direct victims, lack of forensic verification and weaknesses in witness testimony.

It also criticised the use of what it called edited and unauthenticated audio recordings as evidence. IPOB maintained that allegations Kanu imported a transmitter remain unproven, with no documentation to support the charge.

The defence reiterated that the burden of proof lies with the prosecution and that Kanu is presumed innocent until proven guilty. IPOB further claimed that some of the charges contained procedural defects that undermine their validity.

Calling on Justice Omotosho to rule in line with the law, IPOB said the case presents an opportunity to uphold the integrity of the judiciary. The group also urged civil society, the media and international observers to follow the proceedings closely.

Kanu, who has been in custody since 2021, faces multiple charges, including allegations of incitement and unlawful broadcasting. He has denied all charges.
