Detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, has filed a fresh motion at the Supreme Court asking it to set aside its previous judgment ordering his retrial.
Kanu, who is currently in custody, approached the apex court seeking permission to review its ruling delivered in December 2023 in the case between him and the Federal Government.
In the motion, Kanu asked the court to extend the time frame within which he can apply for the review, saying he only recently gained full access to his case documents and is now representing himself.
He argued that the judgment was delivered based on laws that were no longer in existence at the time of the ruling, and claimed that this made the decision invalid.
According to the motion, Kanu said that due to his detention conditions, he was unable to properly examine the judgment and file appropriate responses until late October 2025, when he finally obtained his full case file.
Kanu’s younger brother, Emmanuel, also filed an affidavit in support of the application, saying his brother had not been able to access his legal documents for months and had limited access to counsel while in detention.
Kanu insisted that the Supreme Court should allow him to regularise his legal challenge, arguing that the issue touches on the jurisdiction of the court, which he says should not be restricted by time limits.
The Supreme Court is expected to consider the new application in due course.
