How Orbih’s Legacy PDP Defeated Obaseki’s Team, Legal Perspective

The judgement of the Supreme Court today Friday concerning the authenticity of the Edo PDP delegates is that the court does not have jurisdiction to deliberate on a case brought to it by delegates as their emergence is the party matter.

The party is expected to have followed through the process.

Therefore, the Supreme Court then upheld Court of Appeal earlier ruling that the issue of delegates is a party affair.

The case on the party candidates, which has since been filed and before the Supreme Court, is yet to be decided, which is also expected to go in favor of the Orbih camp having fulfilled all the requirements of the new electoral in conducting their primaries across board.

According to a legal expert Barr. Lawrence Ndukwe Njoku, who spoke to Truthlive.net at the premises of the apex court, “the Supreme Court just like the Appeal court did not say who is PDP authentic or unauthentic delegates, but just the party affairs, the only court that had given a clear cut pronouncement is the federal High Court Abuja”.

“The PDP had accepted the legacy PDP delegates as her duly elected delegates when they accepted them for the national convention to elect the presidential candidate”

In his words: “The supreme court did not ask INEC to remove candidates names already published, the party will stand by that decision to save the party in Edo in other not to resonate the Zamfara PDP episode because of the greed of one man.”

“Therefore, if it is not legacy PDP candidates in Edo state, then PDP does not have Candidates for the 2023 general election as the Obaseki’s camp does not have elected delegates known to law.

By Tuesday 4th Nov 2022, INEC will publish the names of Candidates for Governorship and State House of Assembly candidates.

And Edo Legacy PDP candidates will be on that list.
